Kafalah bil Mal


A type of guaranty (suretyship) that involves securing debts (duyun) and financial obligations (iltizamat maliyah). Kafalah bil mal can be established explicitly by a guarantor stating: “I guarantee the debt of so-and-so”, “I am responsible for so-and-so’s debt or obligation”, etc. It can also be established implicitly by saying: “so-and-so’s debt is mine”, “I guarantee so-and-so”, “I provide guaranty on behalf of so-and-so”, etc. A guaranty may be restricted by description (kafalah muqayyadah), unrestricted (kafalah mutlaqah), subject to a condition (conditional kafalah), or deferred to a certain future date.

Kafalah bil mal (كفالة بالمال) is an Arabic term that translates into financial guaranty.
