Haqq al-Shufa’ah


A contingent right (haqq) that comes into effect properties when are offered for sale. Specifically, it refers to the right of a person (a neighbor/an adjacent owner) to acquire by purchase a real estate property (iqar) in preference to other persons. The neighbor will have the right to force the selling owner (offeror) to sell him all or part of the property in the event of sale. Likewise, in sale transactions (ba’i or bay‘), a person will have the right of first refusal.

Haqq al-shufa’ah (حق الشفعة) is Arabic for right of pre-emption or right of first refusal.
