Ba’i al-Musarrah


Arabic (بيع المصراة) for a manipulative transaction which involves the sale (ba’i) of a cow, she-goat, or ewe, with its udder being tied up by its owner for the purpose of gathering milk therein, giving the impression that it is milch (i.e., produces milk in large amounts). Sellers typically pursue such a manipulative ruse in an attempt to bid up the prices of their animals offered for sale.

A buyer, unknowledgeable of tasryah (udder tying up), has the option (khiyar), for a period of three days, either to retain it or return it to the seller for a refund. Abu Hurairah reported Allah’s Messenger (SAW) as saying: “he who bought a she-goat having its udder tied up should take it, milk it, and, if he is content with its milk, he should retain it, otherwise he should give it back [to the seller] along with a sa’a of dates” (Sahih Muslim, hadith no. 3634).
